Terms and Conditions

Essential Sewing Services Limited (ESS): Our Terms and Conditions

Please read these terms and conditions carefully. You agree that any use of the services provided by ESS shall constitute your acceptance of these Terms and Conditions.

Acceptance of Order 

All business is subject to our terms and conditions of business.

We use Paypal as our online purchasing system. We accept payment by any of the debit or credit cards shown as acceptable on the website at time of purchase.

All prices are shown in UK pounds sterling and are subject to VAT and delivery charges unless otherwise stated. These charges where applicable will be added on confirmation of your address and payment details and prior to the order being placed during the payment process.

Every effort will be made to ensure that prices shown on the website are accurate at the time of purchase. If an error is discovered prior to despatch of your order, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or canceling your order.

When ordering online your order will be sent to us through Paypal by email. You will also receive an email receipt to confirm we have received your order. Should you not receive an email please contact us using the contacts page on our website.
We are under no obligation to accept any order.

Measuring

Goods are altered in accordance with the measurements provided by you. Please follow the instructions on how to measure which are available on our website. Please submit your measurements using our Online Alterations Form. If you are unsure, you can email us for advice and clarification. We cannot accept returns for goods incorrectly measured by you.

Condition of Goods

We have the right to refuse to supply our services if the goods you supply are soiled, marked, faulty or damaged. We will endeavour to advise you of any marks on goods upon receipt of the goods. We reserve the right not to work on soiled goods and will return the goods to you after deducting all fees incurred in respect of postage and administration. The garment’s original finish will be retained where possible or unless otherwise requested. Every effort will be made to match the alterations required with the garment’s original finish but for various reasons it may not be possible to produce an identical finish.

We shall endeavour to inspect the customer’s goods upon delivery to us and advise the customer of any items of property found in the goods but ESS shall not be responsible for any claims in respect of valuables, cash or property claimed to have been left in the customer’s goods.

Prices and Terms

The Price of the Goods shall be as advertised on our website. We reserve the right to change prices and specifications in respect of additional items required or garments that require additional services. An order will not be processed unless we have received the funds in full in respect of all additional goods or services that may be required.

All prices are shown in UK pounds sterling and are subject to VAT and delivery charges unless otherwise stated. Customers receiving goods outside the EEC are responsible for any local taxes and/or duties incurred.

Because all our goods are custom-designed for you and cannot be resold, we require payment in full at the time of placing the order. This must be done using a debit or credit card on the website by providing us with the relevant details. An Order will not be processed unless we have received the funds in full.

If for any reason the customer’s payment is declined after the goods have been received by us, we shall keep the goods and not work on them until an alternative method of payment has been made.

No goods can be released to a customer until payment has been received in full.

Time estimates for services

We aim to return all customer garments within 7 working days of receipt from the customer. We aim to deliver within the timescales stated although at times delivery may be subject to conditions outside our control. All delivery times are approximate and we will not be held liable for any compensation or damages as a result.

Orders are accepted and promises for return of altered goods are given conditionally upon our being able to secure the necessary items required to finalise the required alterations and without responsibility for delays arising through uncertainties of manufacture, strikes, accidents or other causes beyond our control.

Delivery of goods

All goods must be sent to us by recorded delivery. Upon completion of the services, all altered goods will be returned to the customer by recorded delivery. ESS insures returned goods in transit to a maximum sum of £36.00. We cannot accept liability for lost or damaged parcels in transit in excess of this amount. It is the responsibility of the customer to arrange for collection, return carriage and/or additional transit insurance if required.

Returns Policy

Please contact us within 7 days of receipt of your order should you have any queries about the product(s) you have received.

While every effort is made to ensure that you receive the required goods in the best possible condition, please inspect all items carefully upon receipt. Our products are altered/custom-made according to specifications provided by you and therefore we cannot accept returns or refunds on the goods for any aspect of the product which has been determined by you in particular but without limitation incorrect measurements, fabric choices, incorrect measurements of goods at the time of their manufacture, change to finish if we feel it more appropriate to the type of garment or fabric.

Any claim by you which is based on any defect in the quality of the work or failure of the goods to correspond with the specification for work should be notified to us on discovery.  Any valid claim of this sort shall not be accepted by us unless made within 7 days from the date of delivery of the Goods. Customers are required to pay for the carriage of any goods being returned unless the goods were either faulty or the order was sent out in error, in which case we will refund the postage in full. This does not affect your statutory rights.
Please note: no refunds can be given once the altered goods have been returned to the customer and subsequently cut, treated or altered in any way.

In the unlikely event of any proven defect in the quality of the work or failure of the Goods to correspond with the specification, our liability shall be limited to a refund of the total sum paid for the alteration services as set out in our original quote to you. We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the work carried out. This does not affect your statutory rights.

Disputes

In the first instance any complaint should be made direct to our Customer Services Department and we will endeavour to resolve the issue fairly, confidentially, and effectively within 28 days. This does not affect your statutory rights.

Data protection and Privacy

All personal information that you provide, including email and postal addresses will be held in the strictest confidence and only used to fulfil your order with us.

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

We collect information about you for 2 reasons:

Firstly, to process your order and second, to provide you with the best possible service. We will not pass your e-mail address to other trusted traders unless you agree. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely.

We will not accept any responsibility for any web site not under our control, which mat act as a portal for our site, or be connected by hypertext links from our site.

Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these Terms and Conditions at any time. You will be subject to the policies and Conditions in force at the time that you use the website or that you order goods from us.

Governing Law and Jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

If any provision of these Terms and Conditions shall be unlawful, void or for any reason unenforceable then that provision shall not affect the validity and enforceability of the remaining terms and condition.
